Claim Details

The insured was carrying out a conversion of a church into a private dwelling. During the summer of 2006, there was a theft at the premises, and the main electric gates and a large digger excavator were amongst items stolen. This not only caused a delay to the project, but financial loss was a great concern to our client.

The Outcome

We appointed loss adjusters to assist with the claim. They visited the premises and deemed that it was valid, which resulted in a settlement for our client for £21,252.39. Unfortunately nobody has ever been arrested in connection with the theft.
The insured recruited a team to assist him with his self build project. When concrete they were working with entered their boots, various injuries were sustained. One employee, who sustained the most serious injuries, suffered caustic burns and was taken to hospital for a stay of at least four days, in which time he underwent skin grafts. The insured was overseeing the works at the time of the incident and so would have been considered negligent if the employees had made a claim against him. No formal claims were ever submitted and therefore the only payments in respect of this incident were for investigations fees at £808.99.
Severe storms damaged our client’s self build site as gusts reached 80 mph. The gable peak, roof trusses, bracings and wall plates of the property were all damaged by the storm causing great disruption to the project. The insured provided estimates for the repairs for review by loss adjusters. Settlement was reached and the claimant received £5,454.56 plus £728.50 for investigation fees. Total payment £6183.99.
The insured resided in a caravan on the self build site, and upon returning to the risk address one evening he did not notice anything untoward on site due to the fact that it was dark. When he woke the following morning he found that various areas of the site had been damaged by vandals, including window sills and cosh external finishes. The insured contacted the police but to date no-one has been arrested or charged with the offence. Loss adjusters attended the site and provided settlement details of the claim following detailed estimates and invoices. Total settlement to the insured was £22,000.00 with a further payment of £1,374.75 in respect of investigative fees. Total payment £23,024.15.
Our client was embarking on building a new home on rural land owned by his family. The insured was carrying out excavations, possibly during the foundation-laying phase of the self build project, and the telecommunications cables were severed. Current excavation requirements state that any person carrying out excavations must:
  1. Obtain a plan of the area from the various services showing where any cables are located
  2. Carry out test digs (by hand) where excavations are due to take place
  3. Use CATS (Cable Location Detection Machines) before test digs are carried out The insured did not carry out any of the above requirements and so was deemed to be negligent and the claim was paid to BT
